1. Acceptance of Terms

By accessing or using our Services, you ("User," "you," or "your") agree to be bound by these Terms. Please read them carefully. If you do not agree to these Terms or cannot comply with them, you must not use our Platform.

For EU consumers: These Terms comply with European consumer protection laws. Your statutory consumer rights are not affected by these Terms.

2. Eligibility

To use FUTURE EDUCATION Services, you must:

• Have the legal capacity to enter into a binding contract
• Not be prohibited from doing so under applicable law
• Be at least 16 years old (or the minimum age in your jurisdiction)
• Reside in a country where our Services are available

3. About Our Services

FUTURE EDUCATION is a digital school focused on capabilities and skills related to the future of learning. We achieve this by offering certifications and courses that help individuals and organizations use learning to enable new strategies, capabilities, and growth narratives that support the development of more just, equitable, and prosperous societies.

3.1 Intellectual Property Rights

• Using our Services does not grant you ownership of any intellectual property rights in our Services or content
• You may not use content from our Services unless you obtain permission from the content owner or are otherwise permitted by law
• These Terms do not grant you the right to use any trademarks or logos used in our Services
• Do not remove, obscure, or alter any legal notices displayed in or along with our Services

3.2 Service Communications

We may send you service announcements, administrative messages, and other information related to your use of our Services. You may opt out of some non-essential communications through your account settings.

4. Your Account

4.1 Account Creation

Users must create an Account to use our Services as described below.

4.2 Account Security

• You must keep your password confidential to protect your Account
• You are responsible for all activity that occurs in or through your Account
• We recommend not reusing your Account password for third-party applications
• If you become aware of unauthorized use of your password or Account, you must change your password immediately and notify us

4.3 Account Registration Requirements

By registering, you agree that:

• You are not impersonating another person and are using your real identity
• Your registration is subject to verification and confirmation
• Your account will be activated only after confirmation
• Personal information provided during registration is true, accurate, current, and complete
• You will review and update your registration data periodically to ensure accuracy
• Your username and password are unique to you
• You will not disclose or share your credentials with any third party
• You are solely responsible for all activities performed through your account
• You release FUTURE EDUCATION from all claims arising from unauthorized use of your account by third parties

4.4 Account Termination

FUTURE EDUCATION reserves the right to deny or revoke access to any account at its sole discretion.

5. Acceptable Use Policy

You agree to use the Platform only as provided in these Terms and not in any way that conflicts with applicable law. You agree NOT to:

1. Post content in inappropriate categories or areas on our site and Services
2. Infringe laws, third-party rights, or our internal policies
3. Post false, inaccurate, misleading, defamatory, or offensive content
4. Distribute unsolicited spam, mass electronic communications, chain letters, or pyramid schemes
5. Distribute viruses or technologies that may harm the Platform
6. Attempt to modify, translate, adapt, decompile, disassemble, or reverse engineer any software
7. Copy, modify, or distribute Platform rights, content, copyrights, or trademarks
8. Collect or share information about other Users without their consent

6. Service Notifications

As a FUTURE EDUCATION Platform User, you agree to receive essential service-related notifications via SMS, email, or mobile notifications. Options to disable non-essential notifications will be available when you receive them.

7. Right of Withdrawal (EU Consumers)

For EU consumers: You have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with EU Consumer Rights Directive.

7.1 Withdrawal Period

• The withdrawal period expires 14 days after the conclusion of the contract
• For digital content, the withdrawal period expires 14 days after purchase, unless you have given express consent to begin performance during the withdrawal period

7.2 Exercise of Withdrawal Right

To exercise your withdrawal right, contact us at atendimento@futureeducation.digital with a clear statement of your decision to withdraw.

7.3 Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you without undue delay and in any event not later than 14 days from the day we are informed of your decision.

Note: The right of withdrawal does not apply to digital content if performance has begun with your prior express consent and acknowledgment that you lose your right of withdrawal.

8. Privacy Protection and Copyright

8.1 Privacy

Our Privacy Policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that FUTURE EDUCATION may use such data in accordance with our Privacy Policy.

8.2 Intellectual Property Protection

Computer programs, files, texts, icons, designs, videos, sounds, trademarks, logos, layouts, and templates on the Platform are protected by FUTURE EDUCATION's intellectual property rights or those of third parties who have authorized their use. They are protected by applicable laws and international treaties. Any copying, alteration, reproduction, or other use is prohibited.

8.3 Third-Party Links

The Platform may include links to third-party sites and applications. This does not imply that FUTURE EDUCATION endorses, verifies, guarantees, or has any connection with the owners of these sites or applications.

9. Your Content in Our Services

9.1 Content Ownership

You retain ownership of any intellectual property rights that you hold in content you submit to our Services. What belongs to you stays yours.

9.2 Automated Analysis

Our automated systems analyze your selected content to provide personally relevant features such as customized search results and content suggestions. This analysis occurs as content is sent and received.

9.3 Feedback

If you submit feedback or suggestions about our Services, we may use your feedback without obligation to you.

10. Service Modifications and Cancellation

10.1 Service Changes

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.

10.2 User Termination

You can stop using our Services at any time. FUTURE EDUCATION may also stop providing Services to you or create new limits to our Services at any time.

10.3 Data Preservation

If we discontinue a Service, when reasonably possible, we will give you reasonable advance notice and provide you with the opportunity to export your information from that Service.

11. Warranties and Disclaimers

11.1 Service Level

We provide our Services using a commercially reasonable level of skill and care.

11.2 Limitations

Except as expressly set out in these Terms:

• Neither FUTURE EDUCATION nor its suppliers or distributors make any warranties about the Services
• We do not warrant content quality, specific functionalities, reliability, availability, or ability to meet your needs
• Services are provided "as is"

11.3 System Maintenance

Due to system maintenance and improvements, functions may be temporarily disabled. FUTURE EDUCATION cannot be held responsible for temporary restrictions.

12. Service Responsibility

12.1 Service Provision

Upon electronic acceptance of these Terms, FUTURE EDUCATION will provide access credentials to Users, allowing access to all available tools after login activation.

12.2 Service Guarantee

FUTURE EDUCATION guarantees that the Platform will function regularly on reasonable bases during the usage period, excluding:

• Defects from Platform misuse or failure to follow FUTURE EDUCATION guidelines
• System violations by unauthorized third parties
• Problems from telecommunications companies providing internet access signals
• Equipment malfunction due to server downtime

13. Liability and Indemnification

13.1 Limitation of Liability

To the maximum extent permitted by applicable law, FUTURE EDUCATION's total liability to you for all claims relating to these Terms or Services shall not exceed the amount you paid us in the 12 months preceding the claim.

13.2 EU Consumer Rights

For EU consumers: Nothing in these Terms affects your statutory rights as a consumer. If you are a consumer, you may be entitled to remedies under applicable consumer protection laws.

14. Governing Law and Jurisdiction

14.1 Applicable Law

These Terms are governed by the laws of your country of residence if you are an EU consumer. Otherwise, Brazilian law applies.

14.2 Dispute Resolution

For EU consumers: You may bring proceedings in the courts of your Member State of residence or Brazil.

For non-EU users: All disputes will be litigated exclusively in the courts of São Paulo, State of São Paulo, Brazil.

14.3 Alternative Dispute Resolution

EU consumers may access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/

15. Changes to These Terms

15.1 Modification Rights

We may modify these Terms to reflect changes in law or our Services. We will post notices about modifications on this page and provide at least 30 days' notice for material changes.

15.2 Continued Use

Changes will not apply retroactively and will take effect at least 5 days after publication, except for:

• Changes regarding new Service functionalities
• Changes made for legal reasons (effective immediately)

If you do not agree to modified Terms, you must discontinue use of the affected Service.

16. General Provisions

16.1 Entire Agreement

These Terms govern the relationship between FUTURE EDUCATION and you. They do not create any third-party rights.

16.2 Severability

If any provision of these Terms is unenforceable, it will not affect any other terms.

16.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of our rights.
